Virus Truth subpoena: cover-up

Back to court! A waste of all that energy, read the summons here. What I have learned from the previous cases is that Dutch judges function as lawyers for the government. They are the BOAs of parliamentary democracy.

In countries with a more questionable war past or countries that still have memories of a totalitarian regime, judges have a different range of tasks. They are independent controllers of the behavior of the government. If that goes in the wrong direction, judges intervene. Not with us, as has been shown several times. What I understand:

  • Judges monitor the consistency of judgments (case law)
  • They see the code as a reflection of government policy, not as a means of control for that same government
  • They have unshakable confidence in the functioning of parliament
  • they don't check against facts, they are not scientists
  • As civil servants, they shift the burden of proof to the designated authorities. (Comparable to Dutch 'science journalists' who check on the RIVM site whether government policy is correct: testing against the source of error)
  • Disputed facts are a 'battle of scientists'. Judges themselves do not check against the facts – that would also be something nice...
  • It is not in the interest of judges to stand up for citizens, they are protectors of the rule of law
  • Nothing human is alien to them. You don't like to bite the hand that feeds you.

The ombudsman then?

As a legal layman, I no longer see any benefit in these actions of Virus Truth. After the first verdict, my hope for judicial support has evaporated. After all, that first summons, against the RIVM, was actually strong with indisputable scientific substantiations. (no one in my circle of acquaintances has read it completely). I found it disturbing how it was dealt with in court.

Heyt The Netherlands Institute for Human Rights did not give in either, nor did Amnesty. In a later post I will check how they react. For example, we also have a National Health Care Institute that monitors spending (they say). Costs millions, haven't heard anything about it. Ombudsman, not interested in citizens' interests? Of course, the Food and Consumer Product Safety Authority is not about medication or vaccines.

We are at the mercy of a politically correct clique that can hide behind a committee of medical whiners. It will eventually blow over again. It's such a chaotic wandering mess that I can't believe there's a plan behind it.

Willfulness or misunderstanding?

A plan is not a necessity for catastrophic policy. How everything is going clearly shows the vulnerability of our political system. Hopefully this will be corrected in due course because this could end very badly. A pinch more lust for power or conflict of interest from politicians (the doctors are already entangled in a web) and it goes completely wrong. Especially when there is no national press that keeps its finger on the pulse.

I think it's a great pity about all those human lives, all those billions, all that ruined happiness in life, the individual destruction of capital, the disproportionate curtailment of freedom, the loneliness, the rudderlessness.

If only the wasted money that the corona crisis has now caused had been put into care.
